NOTICE OF ADOPTION OF RESOLUTION SUBJECT TO A PERMISSIVE REFERENDUMON NOVEMBER 26, 2018 AND REAFFIRMED ON JANUARY 28, 2019 

NOTICE IS HEREBY GIVEN that the Board of Fire Commissioners of the St. Paul Boulevard Fire District in the Town of Irondequoit, Monroe County, New York, at a meeting held on the 26th day of November 2018, duly adopted the following Resolution, subject to a permissive referendum and reaffirmed on the 28th day of January 2019.

The Board of Fire Commissioners of St. Paul Boulevard Fire District own the real property commonly referred to as fire station #2 at 493 Washington Avenue, Town of Irondequoit, County of Monroe, State of New York, tax account #263400-061-070-0001-006-000, and;

The Board of Fire Commissioners of the St. Paul Boulevard Fire District, no longer finds the ownership of this property necessary for Fire District purposes, 

BE IT RESOLVED by the Board of Fire Commissioners of the St. Paul Boulevard Fire District in the Town of Irondequoit, Monroe County, New York wish to sell or otherwise transfer the real property owned by the St. Paul Boulevard Fire District commonly referred to as fire station #2 at 493 Washington Avenue, Town of Irondequoit, County of Monroe, State of New York, tax account #263400-061-070-0001-006-000.

That this resolution shall not take effect until 30 days after its adoption, or until approved by an affirmative vote of the majority of the duly qualified electors of the Fire District, if a petition, as prescribed by section 6(g) of the General Municipal Law is duly filed with the Secretary of this District protesting against such resolution and requesting a referendum as prescribed in such section of such law.

LEGAL NOTICE

 

 NOTICE OF ADOPTION OF RESOLUTION SUBJECT TO A MANDATORY REFERENDUM ON DECEMBER 26, 2018 AND REAFFIRMED ON JANUARY 28, 2019

  

NOTICE IS HEREBY GIVEN that the Board of Fire Commissioners of the St. Paul Boulevard Fire District in the Town of Irondequoit, Monroe County, New York, at a meeting held on the 26th day of December 2018, duly adopted the following Resolution, subject to a mandatory referendum and reaffirmed on the 28th day of January 2019.

 

BE IT RESOLVED that the Board of Fire Commissioners of St. Paul Boulevard Fire District pursuant to Section 6-g of the General Municipal Law, hereby authorize the District Treasurer to establish a capital reserve fund to be known as the “Facilities Renovation Reserve Fund” (hereinafter “Reserve Fund”).  The purpose of this Reserve Fund is to accumulate moneys to finance the cost of a type of capital improvement. The type of capital improvement to be financed from the Reserve Fund is the reconstruction and renovation of the District’s facilities, including, but not limited to, replacing windows and resurfacing parking lots at the District’s Fire Stations.

 

BE IT RESOLVED the chief fiscal officer is hereby directed to deposit and secure the moneys of this Reserve Fund in the manner provided by Section 10 of the General Municipal Law.  The District may invest the moneys in the Reserve Fund in the manner provided by Section 11 of the General Municipal Law, and consistent with the investment policy of the District.  Any interest earned, or capital gains realized on the moneys so deposited or invested shall accrue to and become part of the Reserve Fund.  The chief fiscal officer shall account for the Reserve Fund in a manner which maintains the separate identity of the Reserve Fund and shows the date and amount of each sum paid into the fund, interest earned by the fund, capital gains or losses resulting from the sale of investments of the fund, the amount and date of each withdrawal from the fund and the total assets of the fund, showing cash balance and a schedule of investments, and shall, at the end of each fiscal year, render to the Board a detailed report of the operation and condition of the Reserve Fund.

 

Except as otherwise provided by law, expenditures from this Reserve Fund shall be made only for the purpose for which the Reserve Fund is established.  No expenditure shall be made from this Reserve Fund without the approval of the Board of Fire Commissioners and such additional actions or proceedings as may be required by Section 6-g of the General Municipal Law or any other law, including a permissive referendum if required by subdivision 7 of Section 6-g.

 

This Resolution is subject to a mandatory referendum and shall, before becoming effective, be approved at a Special Election of the qualified electors of the St. Paul Boulevard Fire District to be held at St. Paul Boulevard Fire Station, 433 Cooper Road, Town of Irondequoit, County of Monroe, State of New York on the 5th day of March 2019, between the hours of 6:00 p.m. – 9:00 p.m.  The District Secretary is hereby authorized and directed to prepare ballots in substantially the following form:  

 

A RESOLUTION AUTHORIZING THE ST. PAUL BOLUVARD FIRE DISTRICT IN THE TOWN OF IRONDEQUOIT, MONROE COUNTY, NEW YORK TO ESTABLISH A CAPITAL RESERVE FUND TO BE KNOWN AS THE “FACILITIES RENOVATION RESERVE FUND HEREINAFTER “RESERVE FUND”.  THE PURPOSE OF THIS RESERVE FUND IS TO ACCUMULATE MONEYS TO FINANCE THE COST OF A TYPE OF CAPITAL IMPROVEMENT.  THE TYPE OF CAPITAL IMPROVEMENT TO BE FINANCED FROM THE RESERVE FUND IS THE RECONSTRUCTION AND RENOVATION OF THE DISTRICT’S FACILITIES.
